If you’re buying or selling a home, you might notice your Realtor (that’s me!) asking for what feels like a ton of personal information—everything from your ID to whether or not you’ve ever been a politician. You might be thinking, “Wait a minute… I’m just trying to buy or sell a house! Why all the questions?” Well, I promise I’m not being nosey—this is all part of keeping things legit and making sure we’re compliant with FINTRAC regulations. Let me explain why this is so important and how it keeps your transaction safe.
What's FINTRAC and Why Should I care?
FINTRAC (Financial Transactions and Reports Analysis Centre of Canada) is a government agency that keeps an eye out for shady financial activity like money laundering and terrorist financing. Because real estate deals often involve large amounts of money, they can (unfortunately) be a target for these illegal activities.
This is where I come in—part of my job as your Realtor is to gather certain information about buyers and sellers to make sure our transaction doesn’t raise any red flags with FINTRAC. So, while I know you’re probably not running an international crime ring (right? 😏), I still have to ask you for certain info to keep everything above board.
What I’ll Be Asking You
1. Proof of ID
I’ll need to verify who you are using a government-issued ID, like your passport or driver’s license. This helps ensure that you’re not using a fake identity (I’m sure you’re not, but rules are rules!).
2. Your Occupation
It might seem odd, but I need to know what you do for work. This is just one more way FINTRAC makes sure that the money being used for a purchase or sale is coming from legitimate sources.
3. Where Your Money’s Coming From
For buyers, if you’re transferring large sums of money, I”ll need some extra details about where those funds came from, including the account number and type. Again, this isn’t because I don’t trust you—I just need to report it if it looks like there’s anything fishy.
4. Politically Exposed Persons (PEP) Rule
Here’s where it gets fun. I’ll also need to ask whether you (or a close family member) have ever been a politician or held a high-ranking government position. FINTRAC pays extra attention to people in these roles because, well, politics and money sometimes have a complicated relationship. If this applies to you, don’t worry—it doesn’t mean you can’t buy or sell your home! It just means we have a little extra paperwork to do.
5. Big Cash Deposits
If you’re planning on paying for your house with a suitcase full of cash (or $10,000 or more), that’s going to raise some eyebrows with FINTRAC. We’ll need to report any large cash transactions, but don’t worry—if everything’s on the up-and-up, it’s just a formality.
